Description: With legislative proposals circulated by Rep. Boucher in May of this year, and Rep. Rush this week, Congress is considering enacting comprehensive privacy legislation that would fundamentally change privacy law in the United States. The impetus for legislation has been rooted in online privacy concerns; however, Congress is considering language that would have a far broader reach, with significant implications for most enterprises that collect, use or disclose personally identifiable information for any reason. New legislation would impose a new array of privacy requirements and subject covered entities to potential civil penalty or damages actions for failure to comply. This panel discusses the legislative proposals, their likelihood for passage, the broader legislative debate over privacy and the ways in which a comprehensive privacy law might impact businesses that collect, manage, and use data about individuals.
