The Supreme Court’s recent decision on campaign finance has greatly affected the political landscape. This panel will explore the impact of that decision from three distinct perspectives.

    Citizens United could undermine the campaign intervention prohibition for public charities and private foundations. Doug Varley from Caplin & Drysdale will discuss the likelihood of such a change, the circumstances under which such a challenge may be brought, and the other tax issues remain for advocacy organizations.

  • Criminal Law - as the Supreme Court carves back on the scope of the permissible administrative regulation of politics, many are watching for signs that criminal prosecutors may step more aggressively into public corruption cases as a result. Leslie Keirnan from Zuckerman will address the impact the Court's recent consideration of honest services fraud may have on this evolution.

  • FCPA - the recent up-trend in cases involving the Foreign Corrupt Practices Act shows no signs of slowing. Kevin Abikoff from Hughes Hubbard will describe the fundamentals of this legal regime, some recent trends and developments anyone active in politics or policy overseas should be aware of, and the degree to which Citizens United may impact the DOJ's approach to these issues.
